Perhaps the most famous example was when the tribunal of the Canadian Human Rights Commission (HRC) filed "charges" against Steyn and Maclean's magazine for publishing an article that some Muslims found offensive. The HRC and the offended Muslims tried to put a lifetime ban on Steyn publishing anything else in Canada ever again. Steyn and Maclean's magazine fought back not just in front of the pseudo-court but in the court of public opinion. When they were done, not only had the case been thrown out, but Section 13 – the law which gave the HRC authority over free speech – was soon after repealed by Parliament.
I'm not sure we'll get that big a pay-off this time, but you never know, do you? Mr McGrath says of my new book:
It seems an odd way to fight a legal battle but the real danger from a court case like this is not the case itself but the climate of intimidation it creates. If a person is afraid to speak out for fear of ending up in court then the opponents of free speech have won.
As one scientist quoted in the book, Professor Ivar Giaever, says, "Global warming has become a new religion-because you can't discuss it, and that's not right."
And, unlike Michael Mann, who still falsely promotes himself as a Nobel Prize winner (although the Nobel Institute has told him to cut it out), Professor Giaever is a genuine Nobel Laureate in a real discipline - winner of the Nobel Prize in Physics.
